1. About Car-Sharing

Car-sharing is a way to have access to a car when needed without having to own it. A Car-Sharing service works as a "shared ownership" car (actually an entire fleet) that its subscribers can use whenever they need it. In this way, the fixed costs related to the ownership of a car (insurance, purchase, taxes) are reduced, paying only for kilometres and hours of use that are identified in the specified rates.
The main difference is that car-sharing users are people who, although they do not need a car on a daily basis, make more or less regular use of the service, while rental is aimed at more specific uses.

On the other hand, unlike car rental, with car-sharing you can use the vehicle for a minimum period of one hour, it is not necessary to reserve it for the entire day. The user can reserve and collect the car at any time (24 hours, 7 days a week), pick it up from a convenient centrally located car park and return it to the same location at the end of its use. Car-sharing users pay a monthly fee and pay for the use of the car according to hours of use and kilometres travelled.
In car-sharing, users share the use of a fleet of cars. The responsible company manages the fleet, assigns the car according to the reservations and invoices the services at the end of the month.

In car pooling, the owner of a vehicle makes seats available in the vehicle to share a certain route with other interested parties. Car Pooling does not need necessarily a company who manages, since the users can agree among themselves.
With a private car, its owners have a series of fixed costs (purchase of the vehicle, circulation and registration taxes, insurance, parking, etc.) and variable costs (maintenance, repairs, ITV and fuel). By comparison if you travel less than 12,000 km/year, car-sharing represents a saving of up to 2,500 euros per year.

2. General aspects

You must fill in the registration form on the Ibilkari Website.

We will check your details and, once we have activated your account, you will receive a ‘Welcome’ message when your registration has been validated.
You must be 25 years of age and hold a valid driving license that is at least 2 years of entitlement to drive.

If you come from outside the European Union and the European Economic Area, you must provide a valid and current International Driving License, or a License written in Spanish. These documents must be accompanied by your passport and driving licence from your country of origin.
Once you have registered, we will check your details.

If everything is correct, we will activate you as a user and you will receive a Welcome email.

From that moment, you will be able to book the vehicle you want through our Reservation System or in the Ibilkari App.
If you wish to unsubscribe, simply send us an email stating that you no longer wish to use the service and we will cancel your user account.
A refundable deposit will be provided upon validation of the registration. The amounts are described in the Rates section of the Website.

The deposit is to ensure that the vehicles we share are used correctly. This amount will be refunded upon request for cancellation of the service, once the amounts that may be pending regularisation have been paid (see the General Conditions for more details).
The user holder may designate a third person free of charge as an additional or ‘authorised’ driver, provided that he/she fulfils the requirements demanded to be able to access the service, subject to prior admission by Ibilkari.

The authorised driver will proceed under the responsibility of the service user, without prejudice to the existence of an assignment of his or her personal obligation as a driver. The user will be held subsidiarily responsible for the uses, services and other concepts of payment that correspond to the authorised driver.
Ibilkari is responsible for the cleaning, maintenance and care of the vehicles on a regular basis.

The philosophy of car-sharing is to promote a lifestyle based on the collaborative economy and, therefore, involves consideration and shared responsibility with other users in the use of the vehicles for the common good and in a friendly manner for the service.

In the event of soiling the vehicle during the booking, either inside and/or outside, you must clean the vehicle during the booking period, at your own expense.

In this way, you will be able to return the vehicle in the clean and hygienic conditions that all other users aspire to share.

In case of omission, Ibilkari, will endorse the corresponding cleaning and hygiene charges (indicated in the User Guide in Section 8, Surcharges and Subscriptions). The expenses for immobilisation and opportunity cost of the vehicle attributable during the cleaning and sanitation intervention time will be accounted for.

3. Reservation and Use of the vehicle

Bookings can be made through the Website or the Ibilkari mobile App. To access you must use the access codes that have been previously sent to you.

For the use of the vehicle, it is recommended to plan the trip in advance and then make the reservation.

Bookings can be made at 30-minute intervals, with a minimum booking duration of 1 hour. Bookings always start at sharp and/or half-hourly intervals.

The vehicle usage time is counted from the start of the booking until the booking is completed and the doors are locked with the Ibilkari mobile App or smart card.
To open and access the vehicle you must use the Ibilkari mobile App, by pressing the ‘key’ or ‘agenda’ symbol on the app screen you can access your bookings, and by sliding the ‘start booking’ button, the vehicle will automatically unlock.

You can also access using a contactless smart card, previously associated with the reservation system. If you have problems logging in, please call our Customer Service Office.
Through the Ibilkari Website or mobile App, you only have to select the vehicle, and set the desired date, start and end time, there are no additional criteria to define a certain period of time.

The estimated cost of your booking will be based on the duration of your booking, and will be automatically updated if there are any changes in the booking period. Day, additional day and week offers will be automatically combined with the hours to offer you the most advantageous option possible.
It's simple, click on your booking (from the Ibilkari Website or mobile App, in the booking calendar) and you can edit or delete the booking. Please note that extending the booking is only possible if no other user has a booking after yours. Also, you cannot delete a booking once it has started, you can only reduce it in time. Unused bookings are also credited.
To avoid delays in the return of the vehicle, it will be necessary to edit and adapt the final time of the reservation via the Ibilkari App, in this way, not only will we avoid harming other users, but we will also prevent the corresponding additional surcharge (for more information in the User Guide in Section 8, Surcharges and Subscriptions).
During the journey, forget about the Ibilkari mobile App or smart card and use the original vehicle key to exit, lock, open, etc. at every stop or transaction you make with the vehicle.
When you have returned the vehicle to the pick-up location and locked it with the Ibilkari mobile App or smart card, the booking is automatically finalised.

Before executing this last step, the vehicle key must be placed in the key box slot in the glove box, in order to lock the vehicle and finalise the booking.
Fuel costs are included in the price of the service.

In each vehicle you will find a card with which you can pay the costs of filling the tank. Before finalising the booking, it is important to remember that the vehicle must always be left with at least 1/3 of fuel in the tank, so that other users can continue to share the service.

On the Ibilkari mobile App screen you will be given the PIN code of the card. When you have filled the tank and paid with the fuel card, you will have to put it back in its place.

The fuel used for compact vehicles is Gasoline 95, in the case of vans it is Diesel.
Before setting off on your journey, you should carry out a visual check of the interior and exterior condition of the vehicle.

If you detect any problem, defect or damage, let us know as soon as possible. In this way, you will foresee your own responsibilities towards third parties and avoid problems that have not been detected beforehand.

You can contact us by calling the Customer Service Office and, if you have an active reservation, you can easily notify us via the Ibilkari mobile App.

This is how it is done:

If the vehicle has any damage click on the Notify Damage icon. If the previous driver has left something in the vehicle, tap the Report Found Object icon, or, also, if you want to report anything else, use the Help icon.

If necessary, please provide an additional description that you feel is of value.

In both cases, you will need to take some photos of the affected areas or of the object found, and then send them to the e-mail address assigned in the Ibilkari mobile App.

No. Under no circumstances may the vehicle be provided to a third party, or to another user, without prior authorisation and written permission from Ibilkari. Each reservation is assigned to a specific user who is registered in the service and only he or she has the right to drive the vehicle, emergency situations could be excluded.

However, the titular user may designate a third person free of charge as an additional or ‘authorised’ driver, provided that he/she fulfils the requirements for access to the service, subject to prior admission by Ibilkari.
Smoking is not permitted inside the vehicle. Ibilkari considers the interior of the vehicle to be a smoke-free space. The violation of the prohibition during the use of the reservation by the user, authorised driver or accompanying passengers, will result in the obligation of the user to financial compensation and / or the revocation of the contract for such conduct.
For health and hygiene reasons (allergic intolerances, etc.), animals and/or domestic pets may only travel in the travel container that corresponds to their size and shape. It is mandatory to clean the vehicle after each booking where any animal and/or domestic pet has been transported. In the event of conduct due to the omission of hygiene, Ibilkari will endorse the user with the charge indicated in Section 8, Surcharges and Subscriptions.

4. Fees and method of payment

Registration:
During the registration process you will have to pay an admission fee. This amount may be deducted in full or in part with the use of the service, in the case that it is established in the Rates section of the Website.

User fee:
Once you have passed the trial period, you must select the type of contract that best suits your intended use. It implies the payment of a monthly or annual fee. If you prefer the annual subscription, you can benefit from an additional discount.

Rates of use:
The total price of the reservation is calculated according to the time duration (hours / days) and the total number of kilometres travelled. Our rates include VAT, fuel, comprehensive insurance, maintenance and 24-hour assistance.

The km pricing incorporates the adaptation to changes in fuel prices on the market, by applying surcharges or discounts. This adjustment will only be made in those months in which there is a variation, in accordance with the ranges established in the Fuel prices section of the website.

Other costs:
In the event of negligent or inappropriate use of the vehicle (late return, dirt in the vehicle, etc.), the surcharges indicated in Section 8, Surcharges and Subscriptions of the User Guide will be applied.

The philosophy of car-sharing is to promote a lifestyle based on the collaborative economy and, therefore, entails consideration and shared responsibility with other users in the use of vehicles for the common good and in a friendly manner towards the service.
Our initial recommendation for the correct selection of the type of contract is to pay attention to the frequency of use one expects to make of the service, taking into account the following considerations:

Occasional Contract:
This type of contract is aimed at users who demand the service sporadically and/or randomly.

Basic Contract:
Modality that offers a fare (with a discount >%30 on the hourly price) aimed at users who make at least 1 trip per month.

Active contract:
This is a type that offers the most advantageous rates (with a discount of >50% on the hourly price) for users who make at least 3 monthly journeys.
Payment for the trial period and occasional use of the service will be made by credit or debit card. An invoice will be issued for each trip and will be sent by email, with the details of your reservation and the corresponding amount.

After this period, the usual method of payment for the service will be through an active bank account of the user, with the option of SEPA direct debit. The user must be the holder of the bank account (or, failing that, of the organisation he/she works for). Invoices will be issued for monthly periods. However, Ibilkari reserves the right to demand any payment without proceeding to the end of the monthly period.

Note: If the user is not the holder of the bank account, an authorised document of payment obligation must be submitted, duly signed by the holder (or organisation) and the corresponding bank.
When the payment is made by credit or debit card indicated by the user, it will be made automatically in the following two (2) time periods:

1.- First, a payment authorisation will be requested based on an estimated cost of the journey (hours booked + kilometres).

2.- When the reservation is finalised, the initial estimated amount will be reconciled until the actual total cost of using the service is reached.

If the authorisation (withholding in advance) of payment is not carried out correctly, it would mean that there is no authorisation to start the reservation and the reservation would be cancelled in order to make the vehicle available to the users.
You can update your general or bank details on our Website or on our Ibilkari mobile App, or by sending us the new details by email to info@ibilkari.com. Change of general details:

Mobile App:
Log in to My profile → Go to ‘Profile’ and change the address details and, → Press ‘Save’.

Website:
Go to your account (small circle in the top right corner with your initials) → Select ‘Profile’ → Update your address details and, → Click ‘Save’.

Change your bank details:

Mobile App:
Log in to My profile → Go to ‘Billing’ and change the details you require and, → Press ‘Save’.

Website:
Go to your account (small circle in the top right corner with your initials) → Select ‘Settings’ → Select ‘Billing’ → Update your details and click → ‘Save’.

5. Insurance, Damages and Surcharges.

In the event of an accident or accident, please follow the recommendations below:

It is imperative to wear the reflective Safety Vest in any stop or emergency situation that occurs in all areas where vehicle traffic is taking place.

It is necessary to use the vehicle's signalling triangles, in order to guarantee road traffic safety for other pedestrians, drivers, etc.

Immediately inform the Emergency and/or Rescue Services (Ertzaintza, State Security Forces, etc.) in case Medical Assistance may be required.

Inform Ibilkari, as soon as possible, by calling +34 689 514 885 (Customer Service Office), in order to initiate the corresponding procedures with the Insurance Company, as well as to facilitate the intervention of the Emergency and/or Rescue Services.

It is compulsory to draw up the Accident Report, regardless of the damage caused. It must clearly and comprehensibly detail the circumstances of the accident, causes, etc., the names and addresses of the injured parties and/or persons responsible for the accident, witnesses, and other truthful information of interest.

It is obligatory to send a copy of the Accident Report to Ibilkari, as well as to provide any additional truthful information on the event that may be required a posteriori, in relation to the circumstances of the accident.

Ibilkari vehicles are covered by comprehensive insurance, with coverage for, among others, Compulsory Civil Liability.

The user will be able to benefit from the Insurance cover, provided that all the obligations assumed in this User's Guide, those established in the Traffic and Road Safety Law in force and all the legislation applicable to the use of motor vehicles are complied with and respected.

Damage to the vehicle and/or third parties will not be covered when the user, or authorised driver, is driving under the influence of alcohol, drugs or other pharmacological substances considered unsuitable for driving.

In the event of being responsible for the accident or accident, the user or authorised driver must pay the compensation resulting from the immobilisation and opportunity cost that correspond during the time of repair.

The amount of compensation will be 100 € (VAT included) per intervention or day that the vehicle is being repaired, with a maximum of 4 days, which corresponds to 400 € (VAT included).

In any case, the user must also pay the excess for damage, accident, fire, etc., of the vehicle: 300 €, and the vehicle accident management costs: 50 € (VAT included).

In the event of damage to the vehicle due to any other cause or reason, regardless of the assumption of responsibility or not, the only person responsible for the damage caused to the vehicle will be the user, as long as it occurs during the period of custody assigned by the reservation, will be the user.
When the Traffic Authority notifies a penalty for infringement of a user. Ibilkari has the duty to send the user's details to the Traffic Authority, so that they can contact the person sanctioned and the object of the infringement. The administrative costs derived from the processing will be applied as indicated in Section 8, Surcharges and Payments of the User Guide.
